I, EAMON RYAN, Minister for Transport, in exercise of the powers conferred on me by section 18 of the Road Traffic Act 1968 (No. 25 of 1968) and the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Transport, Tourism and Sport (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 351 of 2020 )), hereby make the following regulations:

1. These Regulations may be cited as the Road Traffic (Driving Instructor Licensing) (Extension of Period of Validity of Licence) Regulations 2021.

2. In these Regulations –

“ADI card” shall be construed in accordance with Regulation 15(3)(b) of the Regulations of 2009 insofar as it relates to a driving instructor’s licence but does not relate to a trainee driving instructor’s licence;

“driving instructor’s licence” has the same meaning as it has in the Regulations of 2009;

“Regulations of 2009” means the Road Traffic (Driving Instructor Licensing) (No. 2) Regulations 2009 ( S.I. No. 203 of 2009 );

“trainee driving instructor’s licence” has the same meaning as it has in the Regulations of 2009.

3. Notwithstanding Regulations 27(1) and 28(3) of the Regulations of 2009, a driving instructor’s licence (other than a trainee driving instructor’s licence) granted during the period beginning on 1 September 2018 and ending on 3 January 2021 shall expire at the end of the period of 3 years from the date of grant of the licence.

4. A holder of a driving instructor’s licence (other than a trainee driving instructor’s licence) referred to in Regulation 3 shall, notwithstanding the period referred to in Regulation 32(1) of the Regulations of 2009, pass a check test as provided for in that Regulation 32 within the period of 3 years from the date of grant of the licence.

5. Notwithstanding Schedules 5 and 6 of the Regulations of 2009, the date of expiry of a driving instructor’s licence (other than a trainee driving instructor’s licence) referred to in Regulation 3 and of an ADI card issued to the holder of such a licence shall be 1 year from the date of expiry specified on the licence and on the ADI card to be the date of its expiry.
