ROAD TRAFFIC (NATIONAL CAR TEST) (AMENDMENT) REGULATIONS 2008

I, NOEL AHERN, Minister of State at the Department of Transport, in exercise of the powers conferred on me by section 18 of the Road Traffic Act 1961 (No. 24 of 1961) and the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Public Enterprise (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 305 of 2002 )), section 2 of the Road Traffic Act 2006 (No. 23 of 2006) and the Transport (Delegation of Ministerial Functions) (Road Traffic) Order 2008 ( S.I. No. 320 of 2008 ), and for the purpose of giving further effect to Council Directive 96/96/EC of 20 December 1996 1 , Commission Directive 1999/52/EC of 26 May 1999 2 , Commission Directive 2001/9/EC of 12 February 2001 3 and Commission Directive 2003/27/EC of 3 April 2003 4 , hereby make the following regulations:

1. These Regulations may be cited as the Road Traffic (National Car Test) (Amendment) Regulations 2008.

2. In these Regulations, “Principal Regulations” means Road Traffic (National Car Test) Regulations 2003 ( S.I. No. 405 of 2003 ).

3. Regulation 2(1) of the Principal Regulations is amended by substituting for the definition of “vehicle” the following:

“ ‘vehicle’ means a mechanically propelled vehicle having at least 4 wheels, which is constructed primarily for the carriage of passengers and which has a maximum of 8 seats excluding the driver’s seat.”.

4. Notwithstanding Regulation 3, a test certificate or certificate of suitability issued under the Principal Regulations, which is in operation immediately before the making of these Regulations, in respect of a vehicle having a design gross vehicle weight in excess of 3,500 kilograms continues to be a certificate issued under the Principal Regulations and continues in force until the date on which it is due to expire.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations remove the weight limit that previously applied to vehicles for the purposes of testing by National Car Testing Service Limited.
