Abstract:

Unfair dismissal - Conduct - Fair procedures - Warnings - Resignation or dismissal

Claimant was relied upon to train in a new production supervisor. Increasingly, he was called away from his own work to respond to assistance from this manager. On two incidents the claimant, under pressure, used foul language to his manager when called upon for assistance. Following this claimant was called for a meeting the result of which he was asked to resign and given his P45 and outstanding wages. Claimant stated he asked for a reference and claimed that he would not get it until he resigned. Respondents denied that the claimant's P45 was done up in advance of the meeting and claimed that he had offered his resignation.
