SECTION 7(1), PAYMENT OF WAGES ACT, 1991
1. Appeal of Adjudication Officer Decision Nos: ADJ-00020655 CA-00027146.
2. This is an appeal of an Adjudication Officer's Decision made pursuant to Section 7(1) of the Payment of Wages Act, 1991. The appeal was heard by the Labour Court on 28 February 2020 in accordance with Section 44 of the Workplace Relations Act, 2015. The following is the Determination of the Court:-
This is an appeal by Sign Language Interpreting Service against an Adjudication Officer's Decision ADJ-00020655 given under the Payment of Wages Act 1991(the Act) in a claim by Ms Curry that she suffered an unlawful deduction from her wages. The Adjudication Officer up held the Complainants complaint.
In this Determination the parties are referred to as they were at first instance. Hence Sign Language Interpreting Service is referred to as the ‘Respondent’ and Mairead Curry as ‘the Complainant’.
In advance of the hearing the Complainant confirmed to the Court in writing that she would not be contesting the appeal. The Court therefore, upholds the appeal. The Decision of the Adjudication Officer is overturned. The appeal succeeds.
