SOCIAL WELFARE (CONTRIBUTIONS) (AMENDMENT) (NO. 3) REGULATIONS, 1972.

The Minister for Social Welfare, in exercise of the powers conferred on him by sections 3 and 7 of the Social Welfare Act, 1952 , (No. 11 of 1952) hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Social Welfare (Contributions) (Amendment) (No. 3) Regulations, 1972.

(2) The Social Welfare (Contributions) Regulations, 1953 to 1971, the Social Welfare (Contributions) (Amendment) Regulations, 1972 ( S.I. No. 76 of 1972 ); the Social Welfare (Contributions) (Amendment) (No. 2) Regulations, 1972 ( S.I. No. 222 of 1972 ), and these Regulations may be cited collectively as the Social Welfare (Contributions) Regulations, 1953 to 1972.

2. Subject to article 4 of the Regulations, an employment contribution shall be credited to an insured person for each week for which there has been duly paid in respect of that person—

(a) an increase of pension under section 26 (4) of the Social Welfare Act, 1952 (inserted by section 9 of the Social Welfare (Miscellaneous Provisions) Act, 1968 (No. 31 of 1968) ), or

(b) an increase of pension under section 77 (3) of the Social Welfare Act, 1952 (inserted by section 10 of the Social Welfare (Miscellaneous Provisions) Act, 1968 ), or section 77 (5) of the Social Welfare Act, 1952 (inserted by section 16 of the Social Welfare (Miscellaneous Provisions) Act, 1969 , (No. 19 of 1969)), or

(c) an old age (care) allowance under section 21 of the Social Welfare Act, 1970 (No. 12 of 1970).

3. Employment contributions credited under these Regulations shall be reckonable for the purpose of all benefits and pensions under the Social Welfare Acts, 1952 to 1972.

4. (1) Contributions shall not be credited to an insured person under these Regulations until the cessation of the increase or allowance.

(2) An employment contribution shall not be credited to an insured person under these Regulations unless an employment contribution reckonable for benefits including unemployment benefit shall have been paid or credited in respect of such person in either of the two complete contribution years immediately preceding the date from which the increase or allowance was payable.
