Evidence given in the Irish language- Irish language unknown to defendant or his solicitor - Refusal of District Justice to allow interpretation - Conviction - Conviction quashed- Natural justice.

The prosecutor was charged before a District Justice with the commission of certain offences. When a sergeant of the Civic Guard proceeded to give his evidence in the Irish language the prosecutor's solicitor informed the Court that neither he nor his client had a knowledge of that language and he requested that in the circumstances the evidence should either be given in the English language or translated into English. The District Justice refused this request and the evidence having been concluded without calling on the prosecutor's solicitor he gave his decision in Irish.
