Notice of the making of this Statutory Instrument was published in

I, MICHEÁL MARTIN, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993) and, in relation to paragraphs 1(a) to (g), 2(b) to (j), (w)(ii) to (x)(iv), (y) and (z), 3(b) to (f), 4(b) to (h) and 5 of the Schedule to the following order, for the purpose of giving full effect to Regulation (EC) No. 763/2008 of the European Parliament and of the Council of 9 July 20081 , hereby order as follows:

1. This Order may be cited as the Statistics (Census of Population) Order 2020.

2. (1) In this Order -

“census night” means the period of time commencing at 9 p.m. on 3 April 2022 and ending at 7 a.m. on 4 April 2022;

“following morning” means the period of time commencing at 7 a.m. on 4 April 2022 and ending at noon on that day;

“Regulation” means Regulation (EC) No. 763/2008 of the European Parliament and of the Council of 9 July 20081 ;

“residential communal establishment” means a residential communal establishment of any kind, excluding private households, and includes -

(a) a hospital,

(b) a residential facility for persons with intellectual or physical disabilities, or both,

(c) a nursing home,

(d) a children’s home,

(e) student specific accommodation,

(f) a religious community,

(g) a defence establishment,

(h) a prison,

(i) a shelter or refuge,

(j) a hotel,

(k) a boarding house,

(l) a guest house,

(m) a bed and breakfast,

(n) a hostel, and

(o) a campsite.

(2) A word or expression that is used in this Order and also used in the Regulation has the same meaning in this Order as in the Regulation, except where the context otherwise requires.

3. A requirement on the householder or any adult member of a private household to provide -

(a) in respect of the private household that is occupied by the person on census night or the following morning, he or she not having been enumerated elsewhere on that night or morning, information the general nature of which is specified in paragraph 1 of the Schedule,

(b) in respect of each person who is alive and in the State at midnight on Sunday 3 April 2022 and who occupies the private household on census night or the following morning, the person or persons not having been enumerated elsewhere on that night or morning, information the general nature of which is specified in paragraph 2 of the Schedule,

(c) information as to whether any or all members of the private household are temporarily absent from the household on census night and the following morning,

(d) where all members of the private household are temporarily absent from the private household on census night and the following morning, in respect of each member of the household who is so absent, information the general nature of which is specified in paragraph 3 of the Schedule, and

(e) where some but not all members of the private household are temporarily absent from the private household on census night and the following morning, in respect of each person who is so absent, information the general nature of which is specified in paragraph 4 of the Schedule,

is hereby prescribed.

4. A requirement on -

(a) the manager or other person in charge of a residential communal establishment, and

(b) the master or other person in charge of a vessel (other than a vessel comprising a private household) in any harbour, port, bay, creek, lake, river, canal or elsewhere in waters within the jurisdiction of the State,

to provide, in respect of the residential communal establishment or vessel, as the case may be, information the general nature of which is specified in paragraph 5 of the Schedule, is hereby prescribed.

5. A requirement on a person in respect of whom the information specified in paragraph 2 of the Schedule -

(a) is not required by this Order to be provided by another person, or

(b) is not likely to be provided by another person,

to provide, in respect of himself or herself, information the general nature of which is specified in paragraph 2 of the Schedule, is hereby prescribed.

SCHEDULE

General nature of information to be provided for purposes of Census of

Population to be conducted in year 2022

1. Information regarding the following housing characteristics and facilities of a private household referred to in Article 3(a) on census night or the following morning:

(a) age of building;

(b) type of dwelling;

(c) whether the accommodation is owned or rented and, where the accommodation is rented, category of landlord;

(d) number of rooms;

(e) type of fuel used by central heating;

(f) type of piped water supply;

(g) type of sewerage facilities;

(h) where the accommodation is rented, the amount of rent paid and frequency of such payment;

(i) number of working smoke alarms;

(j) whether the accommodation uses renewable energy sources;

(k) number of cars or vans owned or available for use by members of the household;

(l) type of internet connection and type of devices used to access the internet.

2. Information regarding the following, as it relates to each person to whom Article 3(b) or 5, as the case may be, applies on census night or the following morning:

(a) first name and surname;

(b) sex;

(c) date of birth;

(d) in the case of a person who occupies a private household, relationship to each other person who occupies the household on census night or the following morning;

(e) in the case of a person who has attained the age of 15 years, marital status;

(f) place of birth;

(g) usual residence;

(h) usual residence on 3 April 2021;

(i) whether the person has lived outside the State for a continuous period of a year or more and, if so -

(i) country of last previous usual residence, and

(ii) year of last taking up residence in the State;
