Statistics (Producer Prices Survey) Order 2023

I, LEO VARADKAR, Taoiseach, in exercise of the powers conferred on me by section 25(1) of the Statistics Act 1993 (No. 21 of 1993), and for the purpose of giving full effect to Article 6(1)(a) and (b) and (2)(j) of Regulation (EU) 2019/2152 of the European Parliament and of the Council of 27 November 2019 1as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 2021 2, hereby order as follows:

1. This Order may be cited as the Statistics (Producer Prices Survey) Order 2023.

2. (1) In this Order –

“Act of 1993” means the Statistics Act 1993 (No. 21 of 1993);

“monthly reference day” has the meaning assigned to it by Article 6;

“quarter” means a period of 3 months ending on 31 March, 30 June, 30 September or 31 December in any year;

“quarterly reference day” has the meaning assigned to it by Article 7;

“Regulation” means Regulation (EU) 2019/2152 of the European Parliament and of the Council of 27 November 2019 1as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 2021 2;

“Regulation (EC) No. 1893/2006” means Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 2006 3as amended by Regulation (EC) No. 295/2008 of the European Parliament and of the Council of 11 March 2008 4, Regulation (EU) No. 70/2012 of the European Parliament and of the Council of 18 January 2012 5and Regulation (EU) 2019/1243 of the European Parliament and of the Council of 20 June 2019 6;

“survey” means the Producer Prices Survey that is conducted by the Central Statistics Office for the purposes of obtaining information set out in the Schedule for the purposes of compliance with the Regulation, in so far as it relates to Annexes I to V thereto.

(2) A word or expression that is used in this Order and also used in the Regulation has the same meaning in this Order as in the Regulation, except where the context otherwise requires.

3. A requirement on an undertaking that is classified for statistical purposes under section B (other than class 7.21 or division 9), C (other than division 18 or 33, class 24.46 or group 25.4, 30.1, 30.3 or 30.4) or D of NACE Rev. 2 set out in Annex I to Regulation (EC) No. 1893/2006 to provide for the purposes of the survey the information specified in paragraphs 1(a), (c) and 2 of the Schedule is hereby prescribed.
