Practice-Vendors and Purchasers Act, 1874, s. 9. Proceedings under the 37 & 38 Viet. c. 78, s. 9 (Vendors and Purchasers. Act, 1874), are commenced by summons at Chambers. Mr. _Richey, Q. C., applied for directions to the officer of the Court to issue an originating summons entitled in this matter, doubts having been suggested in the office as to whether the proÂÂceedings under the Act should originate in Chambers. The object of the summons was to obtain the opinion of the Court as to cerÂÂtain objections to title. He referred to section 9 of the Act. THE VICE-CHANCELLOR was of opinion that the proper mode of commencing the proceedings was by summons at Chambers as proposed, and accordingly directed the summons to be issued. V. C. Chant. 1877.
