Background

This complaint relates to a mortgage loan account held by the Complainants with the

Provider. The mortgage loan account which is the subject of this complaint was secured on

the Complainants’ private dwelling house.

The Amended Loan Offer dated 23 April 2008 provided for a loan amount of €331,000.00

repayable over a term of 32 years.

The Complainants’ Case

The Complainants submit that they applied for a tracker mortgage loan with the Provider.

The Complainants outline that they were “apparently” issued a Loan Offer dated 15 April

2008 for a loan amount of €331,000.00 repayable over a term of 32 years on a “Variable

ECB Base + 1.10%” rate of interest. The Complainants state that they did not receive this

loan offer from the Provider and were later told that the Provider no longer offered

tracker mortgages.

The Complainants indicate that they received a letter from the Provider dated 29

November 2017 which outlined that the Provider never received the signed Loan Offer
