JUDGMENT OF THE VALUATION TRIBUNAL

ISSUED ON THE 27TH DAY OF JANUARY, 2012

By Notice of Appeal dated 27th July, 2011 the appellant appealed against the

determination of the Commissioner of Valuation in fixing a valuation of €67,400 on the

above described property.

The grounds of Appeal as set out in the Notice of Appeal are:

"The Valuation is excessive and inequitable." "Section 48 of the Valuation Act 2001 has

not been correctly implemented by the Commissioner of Valuation. The principal of

"rebus sic stantibus" should apply and the property should be valued in its actual state.

This point applies to the portion of the NAV attributable to the 1st floor accomodation."
