Vocational Education Superannuation Schemes (Transfer of Departmental Administration and Ministerial Functions) Order, 1998

The Government, in exercise of the powers conferred on them by section 6 (1) of the Ministers and Secretaries (Amendment) Act, 1939 (No. 36 of 1939), hereby order as follows: 1. This Order may be cited as the Vocational Education Superannuation Schemes (Transfer of Departmental Administration and Ministerial Functions) Order, 1998. 2. In this Order "functions" includes powers and duties. 3. (1) Subject to paragraphs (2) and (3) of this Article, there is hereby transferred to the Minister for Education and Science the functions vested in the Minister for the Environment and Local Government by or under the Local Government (Superannuation) Act, 1980 (No. 8 of 1980), as adapted by the Environment (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 322 of 1997 ).

(2) Subject to paragraph (3) of this Article, the provisions of paragraph (1) of this Article shall apply in so far as the exercise of those functions relates to any person—

(a) who is or was employed by a Vocational Education Committee as a teacher, and

(b) whose last employment in an office, the remuneration for which was provided out of funds provided by the Oireachtas, was as such a teacher.

(3) The provisions of paragraph (2) of this Article shall not apply to any person whose last employment in an office, the remuneration for which was provided out of funds provided by the Oireachtas, was as a teacher employed by a Vocational Education Committee in any of the following educational institutions:

(a) any of the institutions specified in column (1) of the First Schedule to the Regional Technical Colleges Act, 1992 (No. 16 of 1992);

(b) the Dublin Institute of Technology or any of the colleges specified in the First Schedule to the Dublin Institute of Technology Act, 1992 (No. 15 of 1992).

(4) References to the Minister for the Environment and Local Government contained in any Act or instrument made thereunder and relating to any functions transferred by this Article shall, on or after the commencement of this Order, be construed as references to the Minister for Education and Science.

(5) For the purposes of paragraphs (1), (2), (3) and (4), schemes and regulations made or deemed to have been made before the commencement of this Order under the Local Government (Superannuation) Act, 1980 , shall, in so far as they relate to persons affected by this Article, be collectively known as the Vocational Teachers' Superannuation Schemes.
