Abstract:

Dismissal - Unfair dismissal admitted by employer - Contention that reinstatement was not in company's interests

The claimant, a Korean national was employed as a chick sexer, a specialised position with the respondent company in which she needed her work permit renewed from time to time. The factory work was organised by another Korean national, Mr Chung. Claimant complained that half her salary was channelled through him and caused delays. On Chung's request the employer cancelled her application to have her work permit renewed. Respondent conceded that she was unfairly dismissed but contended that reinstatement could have grave consequences for the company as it was reliant on Chung for the supply of skilled workers.
