The defendant agreed orally to sell his house to the plaintiff at a certain price. The parties to the contract agreed a date upon which the sale was to be closed but there was no arrangement for the payment to the defendant of a deposit. Each party instructed his solicitor to arrange the completion of the transaction. Correspondence between the solicitors resulted in a written contract containing additional terms, and this document was signed by the plaintiff but was not signed by the defendant. In an action in the High Court the plaintiff claimed the specific performance of the oral contract.
