Procedure:In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 25 of the Equal Status Act, 2000, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

The complainant, referred a complaint under the Equal Status Acts, 2000-2015 to the Workplace Relations Commission on the 27th of March 2017. It is alleged that the complainant, along with members of her family, was refused access to the respondent’s bar and restaurant on the 27th of November, 2016. The complainant submits that the refusal of access took place due to the fact that they are members of the Traveller community. In accordance with his powers under section 75 of the Employment Equality Acts, 1998-2015 and under the Equal Status Acts, 2000-2015, the Director delegated the case to me Orla Jones, an Adjudication/Equality Officer, for investigation, hearing and decision and for the exercise of other relevant functions of the Director under III of the Equal Status Acts, 2000-2015.
