COUNTY REGISTRARS (LAND COMMISSION) REGULATIONS, 1934.

WHEREAS the Minister for Justice has, by virtue of subsection (3) of section 28 of the Land Act, 1933 , (No. 38 of 1933), power to make regulations prescribing the notices to be served and the acts to be done by a county registrar or an under-sheriff before proceeding to levy money under a warrant issued by the Land Commission under that section :

NOW, THEREFORE, I, PATRICK J. RUTTLEDGE, Minister for Justice, in exercise of the powers conferred on me by subsection (3) of section 28 of the Land Act, 1933 (No. 38 of 1933), and of every and any other power me in this behalf enabling, do hereby make the following regulations, that is to say :—

1. These Regulations may be cited for all purposes as the County Registrars (Land Commission) Regulations, 1934.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In the application of these regulations in relation to a county for which there is for the time being an under-sheriff, these regulations shall have effect as if the word " under-sheriff " were substituted for the expression " county registrar " throughout these regulations.

4. Immediately upon receipt from the Land Commission of a warrant issued under section 28 of the Land Act, 1933 (No. 38 of 1933), the county registrar shall serve by post on the defaulter named in such warrant a notice in the form set forth in the Schedule hereto or in a form to the same effect informing such defaulter of the issue of such warrant and giving him fifteen days' notice of the execution of such warrant.

5. If within fifteen days after the service of the said notice on a defaulter, such defaulter lodges with the county registrar a written declaration by such defaulter stating either that he does not owe the amount stated in such notice to be due by him or that he is not the person liable to pay the said amount, the county registrar shall transmit such declaration and the relevant warrant to the Land Commission and await the instructions of the Land Commission in regard thereto.
