Cunningham v Statoil Lucan Road

Claimant work two days (11 hours a week) in respondent service station as shop assistant. Following a day off for a school excursion on one of her work days she became ill and was certified unfit for work She informed her manager that she would be off work for two weeks. Her job was taken over by a new girl and the claimant noticed an advertisement seeking new staff. She tried to contact the owner but was unsuccessful and he did'nt respond to her messages. The Tribunal determined the claimant had been dismissed and deemed it unfail. awarded £300.
