Claimant started as a trainee manager with respondent. A year after starting the claimant entered into a second contract with the respondent. Claimant's contract had a bonus scheme which was linked to performance. The respondent sought to renegotiate terms when it became clear that the bonus payable became significantly high. Claimant declined to renegotiate terms and the respondent invoked the opt-out clause which was in the second contract but not the first contract. Claimant submitted that the opt-out clause was invalid. Respondent submitted that as the claimant consented to its inclusion it should be allowed.
