DISTRICT COURT AREAS (AMENDMENT) ORDER, 1970.

I, DESMOND O'MALLEY, Minister for Justice, in exercise of the powers conferred on me by section 26 of the Courts of Justice Act, 1953 (No. 32 of 1953), hereby order as follows:— 1. This Order may be cited as the District Court Areas (Amendment) Order, 1970. 2. This Order shall come into operation on the 1st day of August, 1970. 3. In this Order "the Principal Order" means the District Court (Areas) Order, 1961 ( S.I. No. 5 of 1961 ). 4. The District Court Areas (Variation of Days and Hours) Order, 1969 ( S.I. No. 19 of 1969 ), shall cease to have effect. 5. Notwithstanding anything in the Principal Order—

(a) a sitting of the District Court shall not be held in the period of six consecutive days commencing on the Thursday before Easter Day in each year or in the period of nine consecutive days commencing on the 23rd day of December in each year, and a sitting of the District Court for the purposes of the transaction of the business of the District Court exercising its civil jurisdiction shall not be held during the month of August in each year;

(b) for the purposes of the transaction of the business of the District Court exercising its summary jurisdiction during the month of August in each year—

(i) each area mentioned in column (4) of the Schedule hereto at a particular reference number shall be a district court area and shall be known by the name mentioned in column (2) of that Schedule at that reference number, and the district court areas created by this Order shall during that month be in lieu of the areas created by the Principal Order for the purposes of the transaction of the business of the District Court exercising its summary jurisdiction;

(ii) sittings of the District Court for the district court area the name whereof is mentioned in column (2) of the Schedule hereto at a particular reference number shall be held at the place mentioned in column (3) of that Schedule at that reference number and on the days and at the hours mentioned in the said column (3) at that reference number immediately after the mention of that place. 6. Business transacted in the District Court which is initiated but will not be completed during the month of August may be initiated, continued and completed as if this Order had not been in force at the time at which such business had been initiated.
