Abstract:

Unfair dismissal - Assult - Assult pay scheme - Conditions of scheme

The claimant was a victim of an assult while on duty. Subsequent to that he was involved in an incident whilst off duty but he failed to report it to the respondent as he was required to do. Following an enquiry he was given a week's notice. Claimant issued an appeal against the dismissal. While the appeal was pending, the claimant accepted a sum of money under the “Assult Pay Scheme” in which he had to sign a form which required that his employment was terminated on accepting the compensation. Respondent claimed that the dismissal was justified. The Tribunal determined that the claimant terminated his own employment and dismissed the claim.
