Duff v Sheet Metal Works Ltd

Claimant was an apprentice with the respondent. He missed two days work for a shoulder injury and was stopped two days pay. The following week he was stopped another two days pay and he raised this with the respondent. A row followed with a conflict of evidence. Claimant stated the respondent became abusive and allegedly told the claimant he could go and find himself another job. Claimant believed that he had been dismissed and left seeking his P45 some weeks later. Respondent disputed the context of the claimant leaving. The Tribunal determined on balance that the claimant was dismissed and it was unfair but he had contributed 40% to his dismissal....
