FACTORIES ACT, 1955 (HOISTS AND LIFTS) (EXEMPTION), ORDER, 1957.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the power conferred on me by subsection (13) of section 33 of the Factories Act, 1955 (No. 10 of 1955), and it having been shown to my satisfaction that it would be unreasonable in the special circumstances of the case to enforce certain requirements of the said section 33 in respect of certain classes or descriptions of hoists or lifts, hereby order as follows :

1. This Order may be cited as the Factories Act, 1955 (Hoists and Lifts) (Exemption) Order, 1957.

2. The requirements of section 33 (except subsections (1), (2) and (6)) of the Factories Act, 1955 (No. 10 of 1955), shall not apply as respects any class or description of hoist or lift specified in the Schedule to this Order.

SCHEDULE.

1. Any hoist or lift of which the platform does not pass through any floor of a building and which is used to give access to the underside of motor vehicles for the purposes of examination, repair, lubrication or the like.

2. Any hoist or lift mounted on wheels, of the type usually known as fork trucks, which is used for the stacking, loading, unloading or transporting of goods or materials.
