I, MARCELLA CORCORAN KENNEDY, Minister of State at the Department of Health, in exercise of the powers conferred on me by section 5 of the Food Safety Authority of Ireland Act 1998 (No. 29 of 1998) (as adapted by the Health and Children (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 219 of 2011 )) and the Health (Delegation of Ministerial Functions) (No. 4) Order 2016 ( S.I. No. 512 of 2016 ), after consultation with the Minister for Agriculture, Food and the Marine and the Minister for Communications, Climate Action and Environment, hereby order as follows:

1. This Order may be cited as the Food Safety Authority of Ireland Act 1998 (Amendment of First and Second Schedules) Order 2017.

2. In this Order—

“Act” means the Food Safety Authority of Ireland Act 1998 (No. 29 of 1998);

“Order of 2014” means the Food Safety Authority of Ireland Act 1998 (Amendment of First and Second Schedules) Order 2014 ( S.I. No. 390 of 2014 ).

3. Part II (as amended by Article 3 of the Order of 2014) of the First Schedule to the Act is amended—

(a) by deleting the following statutory instruments:

“European Communities (Erucic Acid in Food) (Method of Analysis) Regulations 1982 ( S.I. No. 271 of 1982 ).”,

“European Communities (Food Additives) (Purity Criteria Verification) Regulations 1983 ( S.I. No. 60 of 1983 ).”,

“European Communities (Labelling, Presentation and Advertising of Foodstuffs) Regulations 2002 ( S.I. No. 483 of 2002 ).”,

“European Communities (Plastics and other Materials) (Contact with Food) Regulations 2007 ( S.I. No. 587 of 2007 ).”,

“European Communities (Protection of Geographical Indications and Designations of Origin for Agricultural Products and Foodstuffs) Regulations 2007 ( S.I. No. 704 of 2007 ).”,

“European Communities (Transmissible Spongiform Encephalopathies and Animal By-products) Regulations 2008 ( S.I. No. 252 of 2008 ) (Regulations 1, 2, 7, 10(10), 10A, 16(16)-(19), 18-20, 22-35 only in so far as they relate to food safety aspects within the meaning of the first mentioned Regulation).”,

“European Communities (Foodstuffs) (Accession of Bulgaria and Romania) Regulations 2008 ( S.I. No. 392 of 2008 ).”,

“European Communities (Spirits Drinks) Regulations 2009 ( S.I. No. 429 of 2009 ).”, and

“European Communities (Traditional Specialities Guaranteed) Regulations 2010 ( S.I. No. 379 of 2010 ).”, and

(b) by inserting after “European Communities (Import of Personal Consignments of Products of Animal Origin) Regulations 2012 ( S.I. No. 374 of 2012 )” the following statutory instruments:

“European Communities (Foodstuffs) (Accession of Bulgaria and Romania) (Amendment) (No. 2) Regulations 2008 ( S.I. No. 517 of 2008 ).

European Union (Transmissible Spongiform Encephalopathies) Regulations 2015 ( S.I. No. 532 of 2015 ) in so far as it relates to food safety.

European Union (Plastics and other materials) (Contact with food) Regulations 2017 ( S.I. No. 49 of 2017 ).”

4. Part III (as amended by Article 4 of the Order of 2014) of the First Schedule to the Act is amended—

(a) by deleting the following Regulations:

“Commission Regulation (EC) No. 315/93 of 8 February 1993 laying down Community procedures for contaminants in food.”,

“Commission Regulation (EC) No. 608/2004 of 31 March 2004 concerning the labelling of foods and food ingredients with added phytosterols, phytosterol esters, phytostanols and/or phytostanol esters.”,

“Commission Regulation (EC) No. 628/2008 of 2 July 2008 amending Regulation (EC) No. 1898/2006 laying down detailed rules of implementation of Council Regulation (EC) No. 510/2006 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs.”,
