Abstract:

Unfair dismissal - Conduct - warnings on conduct - refusal to instructions from superior

Claimant worked as a polisher for respondent. He was good at his job but had outside pressures and he felt pressure from his production manager. Many incidents occured where the claimant used abusive language and was uncooperative. At meetings to discuss these incidents he used abusive language and on one occasion threw a chair before leaving. At such meeting shop stewards were present. The claimant took sick leave with inadequate explanation. The Tribunal determined that the claimant's behaviour was influenced by his unfortunate family circumstances but found that the company had taken this into account and was not required to do more.
