Date of appointment - Resolution appointing officer "as from 1st April, 1948"passed on 20th March, 1948 - Whether officer liable to make superannuation contributions -Local Government Act, 1925, Part IV - Local Government (Superannuation) Act, 1948, Part II, s. 8.

The plaintiff applied for the post of Agricultural Officer with the Clare County Council. On the 16th March, 1948, the Clare County Committee of Agriculture was informed that the Local Appointments Commission recommended the plaintiff for the post, and on the 20th March the Committee passed a resolution that the plaintiff be appointed "as and from the 1st April, 1948". The plaintiff was so informed and was instructed to take up his duties on the 1st April. Local officials appointed before the 1st April, 1948, were not obliged to make pension contributions, but under the Local Government (Superannuation) Act, 1948, Part II, officials appointed on or after that date were obliged to make contributions.
