Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 14th July, 2017.

An tSeirbhís Oideachais Leanúnaigh agus Scileanna, after making such inquiries as it thinks proper and consultation with organisations and associations appearing to it to be representative of substantial numbers of employers in the activities referred to in this Order and of substantial numbers of persons employed in such activities, in exercise of the powers conferred on it by section 23 of the Industrial Training Act 1967 (No. 5 of 1967) and by section 38 of the Further Education and Training Act 2013 (No. 25 of 2013) hereby makes the following Order:

1. This Order may be cited as the Industrial Training (Information and Communications Technology Industry) Order 2017.

2. The following activities are hereby declared to be designated industrial activities for the purposes of the Industrial Training Act 1967 (No. 5 of 1967):

(a) the installation, commissioning, testing and/or maintenance of electronic communications infrastructure and/or physical infrastructure;

(b) the installation, testing and/or maintenance of services that utilise electronic communications infrastructure and/or physical infrastructure;

(c) the writing, testing, deployment, management and/or maintenance of software code;

(d) the design, installation and/or maintenance of electronic communications networks; and

(e) the provision of support services to users of electronic communications networks.

3. In this Order:

“electronic communications infrastructure” has the meaning given in section 52 of the Communications Regulation Act 2002 ;

“electronic communications network” has the meaning given in section 2 (1) of the Communications Regulation Act 2002 ;

“electronic device” means any device used for generating, communicating, processing, sending, receiving, recording, storing or displaying information by electronic means and includes, without limitation, a computer, mobile phone or tablet computer;

“physical infrastructure” has the meaning given in section 52 of the Communications Regulation Act 2002 ; and

“software code” means any code written in a standard programming language which instructs an electronic device to carry out specific functions.
