The defendants made a compulsory-purchase order for the purpose of acquiring certain lands of the plaintiffs pursuant to the Housing Act, 1966. Section 76 of the Act of 1966 required such order to be confirmed by the Minister for Local Government and the defendants' order was so confirmed. The plaintiff issued a summons in the High Court and claimed that the defendants' order should be quashed. The plaintiffs attempted unsuccessfully to obtain from the Minister a copy of the report made by his inspector after the public inquiry which preceded the confirmation by the Minister. The plaintiffs applied to the court for an order adding the Minister as a defendant in the action so that the plaintiffs could apply subsequently for an order directing the Minister to discover and produce relevant documents.
