IRISH NATIONALITY AND CITIZENSHIP REGULATIONS, 1986. | ||||||||||||||||||||||||||||||||
I, ALAN DUKES, Minister for Justice, in exercise of the powers conferred on me by section 3 of the Irish Nationality and Citizenship Act, 1956 (No. 26 of 1956), hereby make the following Regulations: 1. These Regulations may be cited as the Irish Nationality and Citizenship Regulations, 1986. 2. In these Regulations "the Regulations of 1956" means the Irish Nationality and Citizenship Regulations, 1956 ( S.I. No. 216 of 1956 ). 3. Regulation 4 of the Regulations of 1956 is hereby amended by the deletion of "woman". 4. The form set out in Schedule 1 to these Regulations is hereby substituted for Form 3 in the Schedule to the Regulations of 1956. 5. The form set out in Schedule 2 to these Regulations is hereby substituted for Form 5 in the Schedule to the Regulations of 1956. 6. Forms 6 and 7 in the Schedule to the Regulations of 1956 are hereby amended by the substitution of "18 years" for "twenty-one years". 7. Form 12 in the Schedule to the Regulations of 1956 is hereby amended by the substitution of "Declaration of alienage by a person who is of full age." for "Declaration of alienage by a person who is either of full age or a married woman under that age". | ||||||||||||||||||||||||||||||||

Declaration of acceptance of Irish citizenship as post-nuptial citizenship by alien why has married a person who is an Irish citizen otherwise than by naturalisation or under section 8 or 12 of the above Act (inserted by the Irish Nationality and Citizenship Act, 1986 ). | ||||||||||||||||||||||||||||||||

Except in the case of a woman who is an alien and is making a declaration prior to the 1st day of January, 1987, this declaration must be supported by an affidavit by the spouse who is an Irish citizen to the effect that the couple are living together as husband and wife. The declaration and the affidavit should be made:— | ||||||||||||||||||||||||||||||||
If made in Ireland before a notary public or a commissioner for oaths or a peace commissioner, and if made elsewhere, before a diplomatic or consular officer of Ireland, a notary public, or an person who is by the law of the country in which the declaration is made a commissioner for oaths or other person authorised to take affidavits and for that purpose to administer oaths. | ||||||||||||||||||||||||||||||||
