Murphy v Kenton Utilities and Development (irl) Ltd

Abstract:

The employer was engaged in contract work and had teams engaged to carry out the jobs. A reduction of contract work lead to lay offs.The workers were informed of the position at convened meetings and a list for redundancy was prepared on basis of productivity initially and then volunteers would be accepted. After contact by the union, seniority became significant and a new entrant was let go in preference to the claimant. Claimant disputed that he took voluntary redundancy but he was paid his statutory entitlements and four weeks in lieu of notice.

The Tribunal determined that there was no agreement in place in the company regarding procedure to be adopted in the event of redundancy. So long as it adherred to the general principles of natural justice and is...
