The plaintiff, a labourer aged 36 years, while working on the erection of a building fell some 30 feet to the ground when shuttering, on which he was standing, collapsed. As a result of the fall he suffered severe personal injuries and became totally paralysed from the waist down. The jury returned a verdict in favour of the plaintiff and awarded him the sum of £41,630 5s. and costs. Against this verdict the defendants appealed to the Supreme Court on the grounds that the damages were excessive; were against the weight of the evidence and that the verdict was perverse and...
