LEGALLY BINDING DECISION OF THE FINANCIAL SERVICES AND PENSIONS OMBUDSMAN
This complaint relates to the repudiation of the Complainant’s claim under an insurance
policy held with the Provider.
The Complainant’s Case
This complaint relates to the decision of the Provider to decline the Complainant’s claim
for damage to his mobile home, caused by burst water pipes in early 2018. The
Complainant submits that at the time of the incident, his relative, who was occupying the
mobile home, was away on a business trip.
The Complainant explains that the water had to be kept on during the period when the
property was not occupied, so that there was a continuous supply of water for the
Complainant’s horses. The Complainant further submits that the structure was not vacant
for more than seven days, and he says that the water system stopcock, was not interfered
with.
The Complainant submits that although there had been a weather warning around the
time of the incident that led to the claim, the weather conditions had been poor, but not
severe and there had been no significant drop in temperature or any sign that it would
snow.
