Abstract:

Constructive dismissal - Part-time worker - Change of business opening hours - Change of working hours sought by employer

Claimant had worked in respondent's Chineese restaurant for ten years doing preparatory work in the kitchens on a part-time basis. She worked in the mornings and left her work ready for the chiefs, she had committments in the afternoon and the respondent was agreeable to this once her work was completed. One of the restaurant's changed its opening hours to evening only and the claimant was requested to work afternoons only. Initially she accepted this but later gave her keys back saying she could no longer work for the Chans. She claimed that her hours were changed delibrately to get rid of her. The Tribunal determined that the actions of the respondent did not warrant the claimant...
