Certain lands were devised by willto trustees for a term of 1,000 years to raise portions for the testator's younger children and, subject thereto, to the use of the testator's eldest and other sons in tail male, power being given to each person becoming tenant for life to appoint a jointure rent-charge to his wife and to charge the lands with portions for the younger children of such life tenant. After the death of the testator his eldest son, the tenant for life under the will, appointed a jointure rent-charge to the use of his wife, and charged part of the lands with portions for his two younger sons, and in respect of these matters the settlement created by the will remained subsisting.
