S., an Irish citizen, domiciled and resident in Ireland, was employed on a British registered ship, owned by a British company and plying between British and Irish ports. He was employed under Articles entered into in London. He was injured on the ship while it was proceeding down the River Lee in Co. Cork. On a claim brought by him under the Workmen's Compensation Acts, 1934-1955, against his employers, the respondents, in the Circuit Court in Cork, the Circuit Court Judge dismissed the claim holding that the Act did not apply to the applicant.
