SLAUGHTER OF CATTLE AND SHEEP (REGISTRATION AND LEVY) REGULATIONS, 1934.

WHEREAS it is enacted by subsection (1) of section 4 of the Slaughter of Cattle and Sheep Act, 1934 (No. 42 of 1934), that the Minister for Agriculture may by order make regulations prescribing any matter or thing which is referred to in the said Act as prescribed or to be prescribed, but that no such regulation shall be made in relation to the amount or collection of fees or levies without the consent of the Minister for Finance :

AND WHEREAS the matters or things prescribed by these Regulations are referred to in the said Act as prescribed or to be prescribe :

NOW I, SEAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Slaughter of Cattle and Sheep Act, 1934 (No. 42 of 1934), and of every and any other power me in this behalf enabling, do hereby order and make the following regulations, that is to say :—

1. These Regulations may be cited for all purposes as the Slaughter of Cattle and Sheep (Registration and Levy) Regulations, 1934.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In these Regulations the expression " the Act " means the Slaughter of Cattle and Sheep Act, 1934 (No. 42 of 1934).

4. The certificate of appointment with which every inspector is to be provided under section 5 of the act shall be in the Form S.C.S.1. set forth in the Schedule hereto.

5. —(1) Every application under subsection (1) of section 11 of the act for the registration of premises in the register of slaughtering premises shall be in the Form S.C.S.2 set forth in the Schedule hereto and the directions and instructions contained in or appended to such Form shall be complied with by every person who applies for the registration of any premises in the said register.

(2) Every application under subsection (1) of section 11 of the act for the registration of premises in the register of victualling premises shall be in the Form S.C.S.3 set forth in the Schedule hereto and the directions and instructions contained in or appended to such Form shall be complied with by every person who applies for the registration of any premises in the said register.

(3) The fee of ten shillings which is payable on every application under section II of the Act shall be paid by means of a Post Office Money Order payable to the Paymaster-General at theGeneral Post Office, Dublin, and crossed " & Co. " or by means of a banker's draft or a cheque payable to the credit of the account of the Paymaster-General.

6. Every application under subsection (1) of section 13 of the act for the alteration or cancellation of the registration of any premises registered in either of the registers kept under Part II of the Act shall be in the Form S.C.S. 4 set forth in the Schedule hereto and the directions and instructions contained in or appended to such Form shall be complied with by every person who applies for the alteration or cancellation of any premises registered in either of the said registers.

7. —(1) The records to be kept under subsection (1) of section 16 of the act by every registered proprietor of registered slaughtering premises shall be in such of the Forms S.C.S.5, S.C.S. 5A or S.C.S.5B set forth in the Schedule hereto as are applicable to the business carried on by the registered proprietor of such premises and the entries which shall be made by every such registered proprietor in the said records shall be such as are indicated in the said Forms and such entries shall be made before the removal of any carcase or part of any carcase of cattle or sheep from such premises.

(2) The records to be kept under subsection (1) of section 16 of the act by every registered proprietor of registered victualling premises shall be in such of the Forms S.C.S.6, S.C.S. 6A, or S.C.S.6B as are applicable to the business carried on by the registered proprietor of such premises and the entries which shall be made by every such registered proprietor in the said records shall be such as are indicated in the said Forms and such entries shall be made immediately after receipt of any carcase or part of any carcase of cattle or sheep in such premises.

8. The following shall be the rates of levy on all cattle and sheep slaughtered in registered slaughtering premises for human consumption in Saorstát Eireann, that is to say :—

(a) on all cattle (other than calves aged less than six months) at the rate of one pound per animal, and

(b) on all calves aged less than six months at the rate of one shilling per animal, and

(c) on all sheep at the rate of five shillings per animal.

9. The return to be sent under subsection (2) of section 19 of the act to the Minister for Agriculture by the registered proprietor of every registered slaughtering premises shall be in the Form S.C.S.7 set forth in the Schedule hereto and shall contain the particulars and details reiquired by the said Form.
