SOCIAL WELFARE SCHEMES (CASH SUPPLEMENTS) ORDER, 1947 (SECOND AMENDMENT) ORDER, 1947.

The Government, in exercise of the powers conferred on them by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946), hereby order as follows :—

1. (1) This Order may be cited as the Social Welfare Schemes (Cash Supplements) Order, 1947 (Second Amendment) Order, 1947.

(2) This Order shall come into operation on the 10th day of November, 1947.

2. In this Order the expression " the Principal Order " means the Social Welfare Schemes (Cash Supplements) Order, 1947 ( S. R. & O. No. 76 of 1947 ), as amended by the Social Welfare Schemes (Cash Supplements) Order, 1947 (First Amendment) Order, 1947 ( S. R. & O. No. 307 of 1947 ).

3. (1) Article 5 of the Principal Order is hereby amended by the deletion in paragraph (3) of the words " and maintained in an institution " and the substitution therefor of the words " as a patient in, and maintained by, an institution for the care and treatment of persons of unsound mind which is ".

(2) The amendment effected by this Article shall not entitle a person to a supplement in respect of any day before the commencement of this Order.

4. Article 11 of the Principal Order is hereby amended by the addition after paragraph (2) of the following paragraph :—

"(3) Where a supplement would have been payable but for the failure or neglect of an employer to pay any contributions which under the National Health Insurance Acts, 1911 to 1947, the Unemployment Insurance Acts, 1920 to 1946, or the Widows' and Orphans' Pensions Acts, 1935 to 1947, he is liable to pay in respect of an employee or the failure or neglect of an employer to comply in relation to an employee with the regulations relating to the payment and collection of such contributions, the amount of the supplement which would have been payable but for such failure or neglect shall be recoverable in like manner as the amount of the benefit or pension which would have been payable but for such failure or neglect."

5. The Third Schedule to the Principal Order is hereby amended by the substitution for the table therein of the tables annexed to this Article.

Recipient who is resident as a patient in, and maintained by, an institution supported by one or more than one local authority or out of any public funds or by a charity or voluntary subscriptions and who has no dependants.
