SOCIAL WELFARE (VARIATION OF RATES OF UNEMPLOYMENT ASSISTANCE) REGULATIONS, 1983.

The Minister for Social Welfare, in exercise of the powers conferred on him by section 3 of the Social Welfare (Consolidation) Act, 1981 (No. 1 of 1981) and section 308 of the said Act as amended by section 9 of the Social Welfare Act, 1982 (No. 3 of 1982), hereby makes the following Regulations:—

1. These Regulations may be cited as the Social Welfare (Variation of Rates of Unemployment Assistance) Regulations, 1983.

2. In these Regulations:—

"the Principal Act" means the Social Welfare (Consolidation) Act, 1981 , and

"continuous period of unemployment" shall be construed in accordance with section 135 (2) of the Principal Act.

3. These Regulations shall apply to a person who—

(a) in any continuous period of unemployment has been in receipt of unemployment benefit or unemployment assistance for not less than 390 days, and

(b) is not a person for whom the yearly advantage from the use of land is deemed to be calculated in accordance with the provisions of paragraph (a), (b) or (c) of section 147 (1) of the Principal Act by virtue of the provisions of subsection (2) of section 13 of the Social Welfare Act, 1983 (No. 6 of 1983).

4. The scheduled rate of unemployment assistance shall be varied, in the case of a person to whom these Regulations apply, by the substitution for the rates specified in paragraphs 1 (A) (1) and 1 (B) (1) of Part 1 of the Fourth Schedule to the Principal Act (inserted by the Social Welfare Act, 1983 ) of the rates specified at A and B respectively in the Schedule to these Regulations.

5. These Regulations shall have effect from the 5th day of October, 1983.
