Statistics (Waste Generation and Treatment Survey) Order 2019

I, LEO VARADKAR, Taoiseach, in exercise of the powers conferred on me by section 25(1) of the Statistics Act 1993 (No. 21 of 1993) and, other than in relation to paragraph 1(e)(i) of the Schedule to the following order, for the purpose of giving full effect to Regulation (EC) No. 2150/2002 of the European Parliament and of the Council of 25 November 2002 1as amended by Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 2006 2, Regulation (EC) No. 221/2009 of the European Parliament and of the Council of 11 March 2009 3and Commission Regulation (EU) No. 849/2010 of 27 September 2010 4, hereby order as follows:

1. This Order may be cited as the Statistics (Waste Generation and Treatment Survey) Order 2019.

2. (1) In this Order -

“Regulation” means Regulation (EC) No. 2150/2002 of the European Parliament and of the Council of 25 November 2002 1as amended by Regulation (EC) No. 1893/2006, Regulation (EC) No. 221/2009 of the European Parliament and of the Council of 11 March 2009 3and Commission Regulation (EU) No. 849/2010 of 27 September 2010 4,

“Regulation (EC) No. 1893/2006” means Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 2006 2,

“survey” means the Waste Generation and Treatment Survey 2018 that is conducted by the Central Statistics Office for the purposes of obtaining information set out in the Schedule, including for the purposes of compliance with the Regulation;

“waste code”, in relation to a particular type of waste, means the waste code assigned to that type of waste in the list of waste set out in the Annex to Commission Decision 2000/532/EC of 3 May 2000 5as amended by Commission Decision 2014/955/EU of 18 December 2014 6.

(2) A word or expression that is used in this Order and also used in the Regulation has the same meaning in this Order as in the Regulation, except where the context otherwise requires.

3. This Order applies to an undertaking -

(a) that is classified for statistical purposes under any section of NACE Rev. 2, as set out in Annex I to Regulation (EC) No. 1893/2006, and

(b) in relation to which either or both of the following applies:

(i) the undertaking employs 10 or more persons;

(ii) the undertaking contributes significantly to the generation of waste.
