Tailte Éireann Act 2022 (Valuation Division Fees) Order 2023

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 24 th March, 2023.

I, DARRAGH O’BRIEN, Minister for Housing, Local Government and Heritage, in exercise of the powers conferred on me by section 25 (1) of the Tailte Éireann Act 2022 (No. 50 of 2022), having consulted with the chief executive of Tailte Éireann and with the consent of the Minister for Public Expenditure, National Development Plan Delivery and Reform (as adapted by the Public Expenditure and Reform (Alteration of Name of Department and Title of Minister) Order 2023 (S.I. No. 19 of 2023)), hereby order as follows:

1. (1) This Order may be cited as the Tailte Éireann Act 2022 (Valuation Division Fees) Order 2023.

(2) This Order shall come into operation on 24 March 2023.

2. In this Order -

“existing valuation list” has the same meaning as it has in the Act of 2001;

“replaced valuation list” has the same meaning as in section 23(5) of the Act of 2001;

“valuation list” has the same meaning as it has in the Act of 2001.

3. Where a person wishes to purchase a certified copy extract of an existing valuation list, a valuation list or a replaced valuation list, the fee specified in column 3 of Schedule 1 shall be payable to Tailte Éireann in respect of the item specified in column 2 of that Schedule opposite that fee so specified.

4. Where a person wishes to make an application to Tailte Éireann under the Act of 2001, the fee specified in column 3 of Schedule 2 shall be payable to Tailte Éireann in respect of the item specified in column 2 of that Schedule opposite that fee so specified.

5. Where a person wishes to purchase a copy of a valuation map or a copy of an extract of an archive valuation book specified in column 2 of Schedule 3, the fee specified in column 3 of that Schedule shall be payable to Tailte Éireann in respect of the item specified in column 2 of that Schedule opposite that fee so specified.

6. Where a person submits a Form C3 to Tailte Éireann, the fee specified in column 3 of Schedule 4 shall be payable to Tailte Éireann in respect of the item specified in column 2 of that Schedule opposite that fee so specified.

7. Where an item specified in Schedule 1 or 3 requires handling, dispatch or postage, Tailte Éireann may charge a fee not exceeding the reasonable costs of handling, dispatch or postage.
