"Injury to workman's eye" - "Incapacity" for work - Partial incapacity -Workmen's Compensation Act (No.9 of 1934), s. 23, Sch. III (R. 4).

Where there is evidence that the workman's incapacity, at a date prior to the hearing was total and the evidence further shows that such incapacity has diminished, the Circuit Judge is not entitled to make an award on the basis of continuing total incapacity.
