Facts: The respondent, a Nigerian citizen, resident in Ireland, was the subject of a European arrest warrant issued by the Republic of France. Her surrender was sought relating to offices including the participation in a criminal organisation and laundering the proceeds of crime. She objected to her surrender on the basis of inter alia s. 44 European arrest warrant Act 2003, as amended, in that the alleged offences did not by virtue of their committal elsewhere did not constitute offences under French law. She also objected to her surrender on the basis that it was incompatible with the s. 37 of the Act of 2003, in respect of fundamental rights obligations incumbent upon the State. She and her family lived in Ireland and all of her children were Irish citizens. She further objected to her surrender on the basis of an absence of intention to prosecute at the date of the warrant and the Court considered the question of the date of the issue of the warrant pursuant to s. 21 A of the Act of 2003, as amended.

Held by Edwards J. that s. 44 was not engaged in either of the offences which were the subject matter of the warrant and the objections could not be upheld in that regard. The Court rejected the s. 37 objection on the basis that interests of the respondent did not outweigh the public interest in her extradition. The Court was obliged in the terms of s. 21A to refuse the surrender. There was not decision to charge the respondent in 2012.

The respondent is the subject of a European arrest warrant issued by the Republic of France on the 19 th of July, 2012. The warrant was endorsed by the High Court for execution in this jurisdiction on the 5th of September, 2012, and it was duly executed on the 19 th of September, 2012. The respondent was arrested by Sergeant M.O.E. on that date, following which she was brought before the High Court on the following day pursuant to s. 13 of the European Arrest Warrant Act 2003 (hereinafter "the Act of 2003"). In the course of the s. 13 hearing a notional date was fixed for the purposes of s. 16 of the Act of 2003 and the respondent was remanded on bail to the date fixed. Thereafter, the matter was adjourned from time to time, ultimately coming before the Court for the purposes of a surrender hearing

The respondent does not consent to her surrender to the Republic of France. Accordingly, this Court is now being asked by the applicant to make an order pursuant to s. 16 of the Act of 2003 directing that the respondent be surrendered to such person as is duly authorised by the issuing state to receive her.
