1. This is an appeal pursuant to s. 42 of the Freedom of Information Act 1997, ("the Act") against a decision of the Information Commissioner ("the Commissioner") of 14 th December, 2007, being decision No. 050148, and commenced by originating notice of motion of 18 th February, 2008. The Act contemplates an appeal from the decision of the Commissioner within eight weeks of notification of that decision to the party aggrieved (such notification being effected on 18 th December, 2007) on a point of law only. The applicant ("the Hospital") merely seeks an order quashing the decision of the Commissioner and a "summary of grounds of appeal" was served on the 14 th March, 2008, but there is in existence what is described as an "amended summary of grounds of appeal" which was served on 21 st July, 2008. Any reference to the Act can be taken as amended by the Freedom of Information (Amendment) Act 2003, unless the contrary so appears.
